1. The service
FetchSong helps you find out which song is playing in a video, an audio clip, a video link or the sound around you, and shows you where to listen to it. Results are generated automatically.
2. Who can use FetchSong
You must be at least 13 years old, or the minimum age in your country, to use FetchSong. If you use it on behalf of an organization, you confirm you are allowed to accept these terms for it.
3. Your account
You can try FetchSong without an account. To keep using it you sign in with Google. You are responsible for activity on your account and for keeping access to your Google account secure. Tell us right away if you think your account was used without permission.
4. Plans and limits
- Free: 5 song finds per day, including up to 5 finds from video links.
- Pro: 200 song finds per day, with video links on every find.
Daily limits reset every day. We may change plans, limits and features, and we will tell you before a change that affects a paid plan you have.
5. Pro subscriptions
- Pro is billed in advance and renews automatically each period until you cancel.
- You can cancel at any time. You keep Pro until the end of the period you already paid for.
- Payments are handled by our payment provider. Prices may include taxes depending on where you live.
- Refunds follow our Refund and Cancellation Policy.
- We will give you notice before any price change takes effect, and you can cancel before it does.
6. Your content
You keep all rights to the clips you submit. You give us a limited permission to process them only to identify songs and provide the service. Clips are deleted right after identification, as described in our Privacy Policy.
You confirm that you have the right to submit each clip or link, and that doing so does not break any law or anyone else’s rights.
7. Acceptable use
You agree not to:
- use FetchSong for anything illegal, harmful or abusive;
- submit content you have no right to use, or links to private content you are not allowed to access;
- use bots, scripts or automated tools to access FetchSong, or get around limits, plans or security measures;
- interfere with, overload or try to break the service, or probe it for weaknesses without permission;
- copy, resell or build a competing product from the service or its results;
- upload files designed to cause harm, such as malware.
8. Results and third-party links
Song recognition is automatic and may sometimes be wrong or unavailable. Song details, artwork, previews and links are provided for your information. Links to Spotify, Apple Music, YouTube and other services take you to sites we do not control, and their own terms apply. FetchSong is not affiliated with, endorsed by or connected to those services, or to any artist or label.
9. Our rights
FetchSong, including its design, software and branding, belongs to FetchSong and is protected by law. These terms give you a personal, limited, non-transferable right to use the service. Song titles, artwork and other content shown in results belong to their respective owners.
10. Copyright
We respect the rights of creators. If you believe your rights are being infringed, see our Copyright Policy.
11. Suspension and termination
You can stop using FetchSong and delete your account at any time. We may limit, suspend or close access if you break these terms, if needed to protect users or the service, or if required by law. Where reasonable, we will tell you why.
12. Disclaimers
FetchSong is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, including that the service will be uninterrupted, error-free or that every song will be identified.
13. Limitation of liability
To the extent the law allows, FetchSong will not be liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to FetchSong is limited to the amount you paid us in the 12 months before the claim, or 50 US dollars if that is more. Nothing in these terms limits liability that cannot be limited by law.
14. Indemnity
If you break these terms or the law while using FetchSong, you agree to cover reasonable losses and costs that result for FetchSong, to the extent the law allows.
15. Changes to these terms
We may update these terms. We will change the date at the top and, for important changes, let you know in advance. If you keep using FetchSong after a change takes effect, you accept the new terms.
16. Governing law
These terms are governed by the laws of the place where FetchSong is established, without regard to conflict of law rules. If you are a consumer, you also keep any protections given to you by the laws of the country where you live.
17. General
If part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a right, we do not give it up. These terms, together with our Privacy Policy, Cookie Policy and Copyright Policy, are the whole agreement between you and us about FetchSong.
